Chrimson Graphics is the trading name of Christopher Martin Wilson.

These notes simply outline how I work and what you can expect when we collaborate — all fairly straightforward and in the spirit of goodwill.

 

1 Privacy Policy

Spam is spam, and your information will never be shared.

2 Tenders, pitches, speculative work, ‘loss leaders’, etc

Work on these bases is not undertaken.

3 Payment Terms

To keep things clear and straightforward, the fee, payment terms, and a reasonable timescale for the work to be undertaken are agreed before work begins.

For larger projects, an initial deposit (typically 50%) or staged payments may be requested, with the balance due on completion.

For updates and amendments — if not agreed as a ‘flat fee’, or part of a ‘retainer’ (see 4) — you will not be charged unfairly by the hour for small changes such as minor text edits or the addition of an image. Such work is charged in reasonable quarter-hour increments.

4 Retainer Agreements

A retainer is a monthly fee covering an agreed amount of work time — in effect, the designer is ‘on call’ for a specified number of hours each month.

The Client agrees to pay for these hours whether they are used in full or not. If the work required exceeds the agreed time in a given month, additional time is charged at either an agreed flat fee or in quarter-hour increments. If less time is required, unused hours are not rolled over.

5 Copyright and Ownership

Chrimson Graphics retains ownership of all design concepts and materials produced — including artwork, website architecture, and any other work undertaken (excluding third-party assets) — until full payment has been received. At that point, ownership of the agreed final concept transfers to the Client.

Unless otherwise agreed, working or layered artwork files remain the property of Chrimson Graphics. These may be supplied to the Client or a third party by agreement, and are subject to a release fee (see 8).

Electronic files supplied are for the intended use only and should not be altered, adapted or reused without prior permission.

Unauthorised use of design work prior to full payment may result in the full design fee becoming payable, along with any associated recovery costs or loss of earnings. In the case of website work, access to or use of the site may be suspended until payment is settled.

Design concepts that are presented but not approved remain the property of Chrimson Graphics. Approved and paid-for work may be included in promotional material and portfolio use. Unless requested otherwise, a discreet design credit may be included on completed work (excluding corporate stationery).

The confidential nature of projects is respected, and work will only be displayed once a project is underway or publicly launched.

6 Approval of Artwork

Every effort is made to avoid errors; however, it is the Client’s responsibility to proof-read and approve all final content before production.

Email confirmation is taken as approval to proceed. Once artwork has been approved and released for print or implementation, reprints or refunds cannot normally be offered.

7 Intellectual Property

The intellectual property relating to the creation of graphic designs or websites remains with Chrimson Graphics. Should the Client choose to work with another provider, the original creative elements may not be reused or claimed as new intellectual property without permission.

8 Artwork Release Fee

If working files (such as InDesign, Illustrator, or Photoshop files, or web code) are to be transferred to the Client or a third party, a release fee will apply. This is standard practice and reflects the transfer of intellectual property rights.

Until this fee is settled, such materials should not be reused or passed on to others.

9 Force Majeure

Chrimson Graphics cannot be held responsible for delays or failure in delivery where these arise from circumstances beyond reasonable control.

10 Termination Policy

Occasionally, circumstances beyond the control of either party may require a project to be cancelled.

If a project is cancelled by the Client after work has begun, any deposit paid will be retained to cover time, resources and costs already committed. If the project is substantially underway (typically over 50%), a proportionate fee may be payable for work completed up to the point of cancellation.

In such cases, all rights to the work remain with Chrimson Graphics.

If a project is cancelled by Chrimson Graphics due to unforeseen circumstances, any deposit will be refunded in full.

11 Print Colour Variations

Due to the nature of printing processes, slight colour variations may occur between on-screen visuals and final printed results, or between print runs. This is a normal aspect of CMYK and large-scale printing, and reprints cannot usually be offered on this basis.

12 Disclaimer

Chrimson Graphics cannot be held liable for any loss, damage or data issues arising from the use of this website.
